If you are not aware of Managed Service Company (MSC) legislation, or know little about it, you are not alone. It’s been on the statute book since 2007 yet most contractors haven’t actively considered it, thinking their company could not possibly be mistaken for an MSC. Yet almost two years ago, HMRC wrote to around two-thousand contractors saying it believed they were operating as a MSC and as such, according to HMRC, the contractors owed thousands of pounds in unpaid taxes– tens-of-thousands in some cases.

So began a nightmare for the contractors concerned that is still nowhere close to being resolved. Those that IPSE has spoken to – and we are helping a handful of members unfortunate enough to be caught up in the investigation – are understandably distressed and confused. The first question they asked was ‘what is a managed service company and why does HMRC think my business is one?’
