Freelance Corner is a publication available in print and online, which can be accessed via desktop, tablet and mobile.  It is produced by “IPSE”, The Association of Independent Professionals and the Self Employed Limited (a company limited by guarantee, registered in England, with company number 03770926 whose registered office is at Heron House, 10 Dean Farrer Street, London SW1H 0DX). Members of IPSE and those who access Freelance Corner through the IPSE website, can find the specific membership terms and conditions for the organisation here.

Freelance Corner may be accessed through different mediums (print and online via desktop, tablet and mobile), and consequently the terms and conditions below cover all versions. By accessing Freelance Corner (via whichever medium), you are agreeing to be bound by these terms and conditions.  These terms and conditions constitute a legal agreement between you and IPSE and govern the use of Freelance Corner.  Please therefore read these terms and conditions carefully before you begin to access Freelance Corner. If you do not agree with these terms and conditions you should stop accessing, and should not use, Freelance Corner.

In these terms and conditions, IPSE refers to you, the person accessing/using Freelance Corner as “you”, “your” or “User”.

In these terms and conditions, the following definitions apply:

“Advertising Content” means advertising content appearing in Freelance Corner provided by third parties.

“Content” means all material, information, services and content available on/in Freelance Corner, except for User Content and Advertising Content.

User Comments” means any comments and any material, information and content contained therein (including personal and business data, data, text, photos, graphics or anything else) submitted to, posted in or uploaded to Freelance Corner by you or other users, except for User Content.

User Content” means any material, information and content (including personal and business data, messages, data, text, photos, graphics or anything else) submitted to IPSE for publication in/on Freelance Corner (including the Website) by you and other users, except for User Comments.

Website” means http://freelancecorner.co.uk 

1. Content

1.1 IPSE’s Content

All Content displayed on/in Freelance Corner (including the Website) is the sole property of IPSE (or IPSE is the licensee of such Content), including, without limitation, all applicable copyrights, patents, trademarks, trade secrets, trade names, logos, and other intellectual property rights, as well as text, images, graphics, audio, video and other media. Copyright laws protect the Content both locally and globally.  All of IPSE’s such rights are reserved.

You may print off one copy, and may download extracts or take screen shots from Freelance Corner for your own personal and non-commercial use.

You must not modify the paper or digital copies of any Content/materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.

IPSE’s status (and that of any identified contributors) as the authors of the Content must be acknowledged and maintained.

You must not use any part of the Content for commercial purposes without first obtaining the written consent and a licence to do so from IPSE or IPSE’s licensors.

If you print off, copy or download any part of the Content in breach of these terms and conditions, your right to access/use Freelance Corner will cease immediately and you must, at IPSE’s option, return or destroy any copies of the Content you have made.

1.2 Reliance on Content

The Content and User Content in/on Freelance Corner is provided for general information only. It is not intended to amount to advice on which you should rely. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the Content or User Content.  You are also solely responsible for the use you make of the relevant Content or User Content and any such use is at your own risk.

Although IPSE makes reasonable efforts to update the information in/on Freelance Corner, IPSE makes no representations, warranties or guarantees, whether express or implied, that the Content is accurate, complete or up to date.

1.3 User Content

Users and authors may make submissions for publication online or within the print magazine through the appropriate channels.

The views expressed by other users on/in Freelance Corner do not represent IPSE’s views or values. If you wish to complain about any User Content please see section 6 of these terms and conditions.

Any submission to Freelance Corner should be in line with Freelance Corner’s participation and submission guidelines. Your submission represents your agreement with these guidelines and the relevant terms and conditions.

  • By submitting User Content for inclusion on/in Freelance Corner, you agree that you are the creator of the User Content or that you have received verifiable permission and relevant licences from the relevant content owner to submit it for review and possible publication.

  • You warrant that the User Content does not infringe the intellectual property rights of any other person or organisation.

  • You acknowledge that any view expressed by yourself or others included in your User Content is not a reflection of any opinions or values held by IPSE or any associated writers and editors associated with IPSE or Freelance Corner.

  • You accept that the Freelance Corner editorial team may review your User Content and make revisions including but not limited to, cutting, cropping or editing to allow for publication.

  • You acknowledge that submission to IPSE does not guarantee publication of User Content and IPSE use their sole discretion as to what is published in/on Freelance Corner and are not required to justify reasons for refusing publication.

  • IPSE reserve the right to, remove User Content after publication has occurred for whatever reason and are not required to justify reasons for removal.

  • You warrant that the User Content you submit does not include material that is or could be considered to be defamatory, deceptive, obscene, threatening, libellous or may otherwise cause breach of an individual’s rights.

  • You warrant that the User Content that does not or would not encourage any criminal conduct or give rise to civil liability.

  • You warrant that your User Content does not victimise, intimidate or otherwise cause negative impact on an individual or organisation for reasons of sexual orientation, religious belief, age, ethnical origin, disability or for any other reason.

  • You warrant that the your User Content complies with the Code of Conduct set out in section 2.3 of these terms and conditions below and references in that Code of Conduct to “User Comments” shall be read as “User Content” for the purposes of this section.

  • You warrant that your User Content submission is not intended to cause or transmit software viruses or any interruption or corruption of user computers or of Freelance Corner or the Website.

  • You acknowledge that the nature of the Website [and other mediums] means that content format may change to adapt to the technological availability and Freelance Corner cannot guarantee that posts will not be deleted without notification due requirements.

IPSE accepts no liability in respect of any User Content submitted by you or other users and published by IPSE or by authorised third parties nor does IPSE accept or assume liability for any loss or damage to it or arising from it.  IPSE does not assume or accept liability for any User Content which does not comply with IPSE’s submission and participation guidelines. You are solely responsible for your use of Freelance Corner and the Website and any User Content posted or made available by you.  You are also solely responsible for the use you make of the relevant User Content (including User Content posted by others) and any such use is at your own risk.

IPSE’s submission and participation guidelines and the Code of Conduct must be complied with in spirit as well as to the letter. The standards apply to each part of any User Content as well as to its whole.

IPSE will determine, in its discretion, whether User Content breaches IPSE’s submission and participation guidelines or the Code of Conduct.

You warrant that User Content complies with the standards in IPSE’s submission and participation guidelines and the Code of Conduct, and you will be liable to IPSE and indemnify IPSE for any breach of that warranty and those warranties set out above. This means you will be responsible for any loss or damage IPSE suffers as a result of your breach of warranty.

When IPSE considers that a breach of IPSE’s submission and participation guidelines or the Code of Conduct has occurred, IPSE may take such action as IPSE deems appropriate.

Failure to comply with IPSE’s submission and participation guidelines or the Code of Conduct constitutes a material breach of these terms and conditions, and may result in IPSE taking all or any of the following actions:

  • Immediate, temporary or permanent withdrawal of your right to use the Website or access Freelance Corner

  • Immediate, temporary or permanent withdrawal of access to your account on the Website

  • Immediate, temporary or permanent removal of any User Content

  • Issue of a warning to you

  • Legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach

  • Further legal action against you

  • Disclosure of such information to law enforcement authorities as IPSE reasonably feel is necessary or as required by law.

IPSE excludes its liability for all action IPSE may take in response to breaches of IPSE’s submission and participation guidelines or the Code of Conduct. The actions IPSE may take are not limited to those described above, and IPSE may take any other action IPSE reasonably deems appropriate.

Any User Content you submit to IPSE will be considered non-confidential and non-proprietary. You retain all of your ownership rights in User Content submitted by you, but you are required to grant IPSE and other users of Freelance Corner a limited licence to use, store and copy such User Content and to distribute and make it available to third parties.

When you submit User Content to IPSE, you grant IPSE the following rights to use that User Content:

  • A perpetual, worldwide, non-exclusive, royalty-free, transferable licence for IPSE to use, reproduce, distribute, prepare derivative works of, display, and perform that User Content in connection with the service provided by IPSE and Freelance Corner and across different media and to use the User Content to promote Freelance Corner.

  • A perpetual, worldwide, non-exclusive, royalty-free, transferable licence for other users of Freelance Corner to use the User Content in accordance with the licences granted to them under these terms and conditions.

IPSE also has the right to disclose your identity to any third party who is claiming that any User Content submitted, posted or uploaded by you constitutes a violation of their intellectual property rights, or of their right to privacy.

IPSE has the right to remove any posting you make if, in IPSE’s opinion, your post does not comply with the content standards set out in IPSE’s submission and participation guidelines or the Code of Conduct.

You are solely responsible for securing and backing up User Content submitted by you.

1.4 IPSO Editors’ Code of Practice

Although IPSE is not regulated by the Independent Press Standards Organisations (“IPSO”)  IPSE aims to follow the IPSO Editors’ Code of Practice.

1.5 Third party advertising

All Advertising Content seen on/in Freelance Corner is submitted by third parties. Freelance Corner do not accept any responsibility in respect to errors, omissions or inaccuracies present in such Advertising Content. Responsibility for such Advertising Content remains with the submitting third party.

1.6 Website’s linked to

Where Freelance Corner or the Website contains links to other sites and resources provided by third parties, these links are provided for your information only. Such links should not be interpreted as approval by IPSE of those linked websites or information you may obtain from them.

IPSE has no control over the contents of those sites or resources.

2. Commenting

2.1 Account Registration

To submit User Comments in response to articles published on/in Freelance Corner, you are required to register an account under the comments section and validate an email address. Any password created must be remain confidential as account identifiers will be used to link all activities, which occur under your account. You must not disclose your password to any third party.

IPSE has the right to disable any password, whether chosen by you or allocated by IPSE, at any time, if in IPSE’s reasonable opinion you have failed to comply with any of the provisions of these terms and conditions.

If you know or suspect that anyone other than you knows your password, you must promptly notify IPSE using the contact details set out in section 13 of these terms and conditions.

2.2 User Comments are not approved by IPSE

The Website may include User Comments uploaded by other users of the Website. Such User Comments have not been verified or approved by IPSE. The views expressed by other users on the Website do not represent IPSE’s views or values.

The Website may include information and materials uploaded by other users of the Website. This information and these materials have not been verified or approved by IPSE.

If you wish to complain about information and materials uploaded by other users please see section 6 of these terms and conditions.

2.3 Uploading User Comments to the Website

Whenever you make use of a feature that allows you to upload User Comments to the Website, you must comply with the following content standards (Code of Conduct):

User Comments must:

  • Be accurate (where it states facts)

  • Be genuinely held (where is states an opinion)

  • Comply with all applicable laws and regulations, including the law of England and Wales and the law in the country from which it is uploaded or posted.

User Comments must not:

  • Be defamatory of any person

  • Be obscene, offensive, hateful or inflammatory

  • Promote sexually explicit material

  • Promote violence

  • Promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age

  • Infringe any copyright, database right or trade mark of any other person

  • Be likely to deceive any person

  • Breach any legal duty owed to a third party, such as a contractual duty or a duty of confidence

  • Promote any illegal activity

  • Be in contempt of court

  • Be threatening, abuse or invade another’s privacy, or cause annoyance, inconvenience or needless anxiety

  • Be likely to harass, upset, embarrass, alarm or annoy any other person

  • Impersonate any person, or misrepresent your identity or affiliation with any person

  • Give the impression that the User Comment emanates from IPSE, if this is not the case

  • Advocate, promote, incite any party to commit, or assist any unlawful or criminal act such as (by way of example only) copyright infringement or computer misuse

  • Contain the personal data of any other person (although you may share your own personal data)

  • Contain a statement which you know or believe, or have reasonable grounds for believing, that members of the public to whom the statement is, or is to be, published are likely to understand as a direct or indirect encouragement or other inducement to the commission, preparation or instigation of acts of terrorism

  • Contain any advertising or promote any services or web links to other sites

The Code of Conduct must be complied with in spirit as well as to the letter. The standards apply to each part of any User Comment as well as to its whole.

3. Viruses

IPSE does not guarantee that Freelance Corner or the Website will be secure or free from bugs or viruses.

You must not misuse Freelance Corner or the Website by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. You must not attempt to gain unauthorised access to Freelance Corner or the Website, the server on which the Website is stored or any server, computer or database connected to the Website. You must not attack the Website via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. IPSE will report any such breach to the relevant law enforcement authorities and IPSE will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use Freelance Corner and the Website will cease immediately.

4. Limitation of liability

IPSE does not exclude or limit in any way its liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by IPSE’s negligence or the negligence of IPSE’s employees, agents or subcontractors and for fraud or fraudulent misrepresentation.

IPSE excludes all implied conditions, warranties, representations or other terms that may apply to Freelance Corner and/or the Website or any content on/in it.

IPSE will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:

  • use of, or inability to use, Freelance Corner or the Website;

  • use of or reliance on any content displayed on/in Freelance Corner or the Website.

In particular, IPSE will not be liable for:

  • loss of profits, sales, business, or revenue

  • business interruption

  • loss of anticipated savings

  • loss of business opportunity, goodwill or reputation

  • any indirect or consequential loss or damage.

5. Indemnification

You agree to indemnify, defend and hold IPSE and its officers, employees, affiliates, agents, licensors and suppliers harmless from and against all claims, losses, expenses, damages, and costs, including reasonable professional fees, resulting from any breach of these terms and conditions by you.

6. Complaints

If you have a complaint about any editorial content published in Freelance Corner, whether in print or on the Website, you should submit your complaint in writing to:

7. Data protection

Freelance Corner and IPSE will use your personal data as set out in IPSE’s data policy which can be found here.

8. Links to the Website

You may link to the Website home page, provided you do so in a way that is fair and legal and does not damage IPSE’s reputation or take advantage of it.

You must not establish a link in such a way as to suggest any form of association, approval or endorsement on IPSE’s part where none exists.

You must not establish a link to the Website in any website that is not owned by you.

IPSE reserves the right to withdraw linking permission without notice.

If you wish to link to or make any use of the Content or User Content in Freelance Corner/on the Website other than that set out above and in these terms and conditions, please contact IPSE using the contact details set out in section 13 these terms and conditions.

9. Waiver

The failure by IPSE to enforce any provisions of these terms and conditions will not constitute or be construed as a waiver of such provision or the right to enforce them at a later date.

10. Governing law & jurisdiction

These terms and conditions (including their subject matter and formation) are governed by English law and you and IPSE agree to submit to the exclusive jurisdiction of the English courts.

11. Changes to the Website and Freelance Corner

IPSE may update and change the Website from time to time to reflect changes to IPSE’s products, IPSE’s users’ needs and IPSE’s business priorities.

Freelance Corner and the Website is made available free of charge.

IPSE does not guarantee that Freelance Corner or the Website, or any content in/on it, will always be available or be uninterrupted. IPSE may suspend or withdraw or restrict the availability of all or any part of Freelance Corner and/or the Website for business and operational reasons.

12. Changes to these terms and conditions of use

IPSE reserves the right to make changes to these terms and conditions from time to time. Terms and conditions posted on the Website will be applicable at the time of use and the most recent set of terms and conditions will be found on the Website. It is your responsibility to regularly review these, as use of Freelance Corner is an accepted indication that you agree to the terms and conditions.
